Important Concepts

The courts presume level of sophistication on both  the property owner (or commercial tenant),  contractor, sub, and supplier. Thus, although  consumer protection law may not apply to  commercial construction agreements, the courts will  expect the parties to adhere to the formalities that  appear in the contract. For example, if there is an  arbitration or alternative dispute resolution (ADR) clause in your agreement, the courts will assume  that’s what the parties wanted unless they stipulate  otherwise.
