Understanding the Law

A contractor fails to provide a notice of rescission but  otherwise provides a writing in compliance with the  Act (start date, end date, etc.) may recover the  reasonable value of work performed. This appears in  part “g” of the Act:

(g) Contractor’s recovery right.–Nothing in this  section shall preclude a contractor who has complied  with subsection (a) [a sufficient writing] from the  recovery of payment for work performed based on  the reasonable value of services which were  requested by the owner if a court determines that it  would be inequitable to deny such recovery.
