Non Compliance
Relatively few home improvement contracts comply in full  with the Act, leaving the contractor exposed to  numerous claims by the home owner or the attorney  general. Although certain companies (such as Home  Depot and Lowes) utilize the appropriate language in  their written agreements and disclosures, compliance  cannot be assumed in any given case. The initial  contract signed in the store may comply, but as  mentioned, any modification must be in writing. Plus,  any company — no matter how reputable — can be  guilty of rushing the customer to sign on the bottom  line and fail to abide by all the formalities. It pays to  have a lawyer review any agreement to know exactly  where you stand.
